SCENIC ROAD CIDER’S LOCAL LOVE CONTEST RULES & REGULATIONS

No purchase is necessary to enter or win. A purchase does not increase the chances of winning.

Eligibility: (“Contest”) is open only to legal residents of the Province of British Columbia who are 19 years of age or older as of October 16, 2020. The Contest is void where prohibited by law. Employees of Scenic Road Company Inc. (the “Sponsor”) their respective affiliates, representatives, successors, assigns, officers, directors, subsidiaries, advertising and promotion agencies, suppliers (the “Promotion Entities”) and their immediate family members and/or those living in the same household of each are not eligible to participate in the Contest. The Contest is subject to all applicable federal, provincial and local laws and regulations. Void where prohibited.

Agreement to Rules:

By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor, as final and binding as it relates to the Contest. The Contest is subject to all applicable federal, provincial and local laws.

Contest Period:

Entries will be accepted online starting on or about 9:00 a.m. ET on Monday, October 12, 2020 and ending at 11:59 p.m. ET Friday, November 20, 2020. All online entries must be received by 11:59 p.m. ET Friday, November 20, 2020.

How to Enter:

The Contest must be entered by submitting an entry using the online form provided on the Contest Website at scenicroadcider.com/locallove. All fields are mandatory unless stated otherwise. Entries that are not complete or do not adhere to the Rules or specifications may be disqualified at the sole discretion of Sponsor. You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the Rules. If you use fraudulent methods or otherwise attempt to circumvent the Rules your entry may be removed from eligibility at the sole discretion of Sponsor.

Limit: One (1) entry per person.

Prizes:

There is one prize available to be won :

Scenic Road Gift Pack (ARV: $300 CAD)

Note: The prize does not include cider; they are comprised of Scenic Road branded merchandise, gift cards and sponsored prizes.

Actual/appraised value may differ at time of prize award. Prize must be accepted as awarded and may not be substituted or transferred, except at Sponsor’s sole discretion. Sponsor reserves the right, at its sole discretion, to substitute a prize of greater or equivalent monetary value if a prize cannot be awarded as described for any reason. Prizes will be delivered to verified winners only to one (1) address in British Columbia. Sponsor will not replace any lost or stolen prizes. Any other costs or expenses associated with the prizes not specified herein will be the responsibility of selected winners.

Odds: The odds of winning depend on the number of eligible entries received.

Winner Selection:

On or about November 20, 2020 a random draw will be held from among all eligible entries received during the Contest Period for the purpose of selecting the potential winners of the grand prize, (subject to satisfying the prize claim conditions below).

Prize Claim Conditions and Notification:

Selected entrants will be notified at the email address used to enter the Contest within five (5) days following the potential winner selection. In order to be declared a winner, selected entrant(s) must: (i) respond to notification of selection within fifteen (15) business days of first attempt by Sponsor; (ii) correctly answer a time-limited mathematical skill-testing question, without assistance of any kind, to be administered by telephone at a mutually convenient time; (iii) sign and return to Sponsor, within three (3) business days of it being sent by Sponsor (at its sole discretion), a written declaration and release form, releasing the Promotion Entities from any liability in connection with this Contest or the use, misuse, awarding or possession of any prize (the “Release”); and, (iv) otherwise comply with these Rules.

Sponsor shall have no liability for a selected entrants’ failure to receive notices due to spam, junk e-mail or other security settings or for incorrect or otherwise non-functioning contact information. Return of any prize or winner notification as undeliverable, inability to reach selected entrant or failure of selected entrant to respond to notification within fifteen (15) business days of first attempt by Sponsor or Sponsor’s agent, failure to provide proof of eligibility (if requested), Release, or other required documentation in a timely manner, failure to correctly answer the skill-testing question, or other non-compliance with these Rules may result in disqualification, forfeiture of the prize and, at Sponsor’s sole discretion, selection of an alternate eligible entrant for the forfeited prize in accordance with these Rules, who will be subject to disqualification in the same manner.

Protection Of Personal Information and Publicity Release:

Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Contest for the purposes of administering the Contest and prize fulfillment. You may be offered the opportunity to receive additional communications from Sponsor or its partners about its products, and upcoming contests and promotions. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the email. By accepting a prize, winner agrees to Sponsor’s use of his/her name, city/province of residence, picture, biographical information, statements, voice and likeness in any advertising and publicity Sponsor and its respective successors, assigns and licensees may conduct relating to the Contest in any media or format, whether now known or hereafter developed, including but not limited to the World Wide Web, at any time or times in perpetuity, without further compensation or notice, and hereby releases Sponsor and the Promotion Entities from any liability with respect thereto.

General Conditions:

Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Contest should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or website or violates these Rules. Sponsor has the right, in its sole discretion, to maintain the integrity of the Contest, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by the Rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The receipt by winner of the prize offered in this Contest is conditioned upon compliance with any and all federal and provincial laws and regulations. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors. Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. If any provision of the Rules is determined to be invalid or otherwise unenforceable, then the Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate or necessary to comply with applicable law. Should a winner make any false statement(s) in any document referenced above, the winner may be required to promptly return to Sponsor his/her prize, or the cash value thereof. Any violation of these rules by any winner (at sponsor’s sole discretion) will result in such winner’s disqualification as winner of the contest and all privileges as winner will be immediately terminated.

Limitation of Liability:

By entering you agree to release and hold harmless sponsor and the promotion entities from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (I) such entrant’s participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or internet service; (iv) unauthorized human intervention in any part of the entry process or the contest; (v) electronic or human error which may occur in the administration of the contest or the processing of entries (vi) any claims based on personality or privacy rights, defamation or merchandise delivery.

Disputes:

This Contest is governed by the laws of Canada and British Columbia, without respect to conflict of law doctrines. As a condition of participating in this Contest participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in British Columbia having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable lawyer’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest) , and participant further waives all rights to have damages multiplied or increased.

In the event of a dispute as to the identity of the person who submitted any entry, the authorized account holder of the e-mail address submitted during Contest registration will be deemed to be the entrant.

The “authorized account holder” is the natural person assigned an e-mail address by an access provider, service provider, or other person or organization responsible for assigning e-mail addresses for the account associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
